Legal aspects of surrogacy

Surrogate mother
Surrogacy can also be how an embryo is implanted in the womb of a surrogate woman that completes the pregnancy. Strictly speaking, only the fertilized egg (embryo) is transferred into the womb of a surrogate in a process called gestational surrogacy. Traditional surrogacy, which is that the husband's sperms are not allowed to be inserted into the surrogate.
Who needs surrogacy?
Absent uterus due to hysterectomy, or congenital absence of the uterus.
• Defective uterus (eg unicorn uterus).
• Poor endometrium lining.
• Frequent IVF failure.
• There is no cure for recurrent miscarriage.
• Serious medical conditions incompatible with pregnancy.
• single parents.
Surrogacy Process
Upon selection of a surrogate, the egg provider (the female partner herself or the egg donor) cycles in sync with the surrogate. This means that the preparation of the surrogate's endometrial lining and thus the egg provider are administered injections for egg stimulation simultaneously. Egg collection is usually completed between 10-14 days after stimulation, and becomes fertilized with the husband's healthy sperm. The fertilized egg (embryo) is then transferred to the surrogate's uterus after 3 to 5 days. The bioassay is run after 2 weeks. Extra and healthy embryos are frozen for later (if necessary) transfer.

Legal aspects of surrogacy:
Couples seeking surrogacy can either bring their own surrogate or the clinic can provide a surrogate through a licensed agency. Government of India guidelines on IVF surrogacy make it a legal process, which requires the names of the intending parents to be entered on the certificate. Surrogacy Process at AFGC:
Although we have access to a surrogate home, we do not encourage our surrogate to be placed in a surrogate home, as they are mostly young mothers with young children. We believe in providing our surrogates a happy pregnancy, and want them to be with their families instead of being in isolation for nine months. Our well trained surrogate caretaker visits the pregnant surrogate frequentlyand ensure that proper care is taken. Our doctors monitor the pregnancy every 2-3 weeks to ensure a healthy fetus. Clinic coordinators also make frequent visits to surrogates' homes to ensure that full care is being taken
In fact, prenatal visits and regular ultrasounds occur with a higher frequency than a normal pregnancy to ensure a healthy pregnancy. Dr Gauri Agarwal
personally selects the surrogates and monitors their progress throughout the pregnancy. However, if any medical problems arise during pregnancy, we accept surrogates immediately. If a parent specifically wants a surrogate to live in a rented home, we have provisions for that.
Cost of Surrogacy at AFGC:
Depending on the size of surrogacy (self-egg or donor egg surrogacy) the cost of surrogacy is around Rs 13 to 14 lakhs which includes 3 attempts.
